1. Acceptance of Terms

By accessing or using Kids Adventure ("the App", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Kids Adventure. If you are a parent or guardian agreeing to these Terms on behalf of a child, you represent that you have the legal authority to bind the child to these Terms.

2. Eligibility

The App is designed for use by children and their parents or guardians. To use the App:

• You must be at least 13 years old to create an account, or
• A parent or guardian must create an account on behalf of a child under 13
• You must have the legal capacity to enter into these Terms
• You must comply with all applicable laws and regulations

3. Account Registration and Security

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account

3.2 Account Deletion

You may delete your account at any time through the App settings or the Account page on our website (kidsadventure.app). Account deletion will:

• Permanently delete all your account data from our servers (authentication, subscriptions, credits, user profile)
• Remove your access to the App and all associated services
• Result in the loss of any unused credits or subscriptions
• Note: Videos, photos, and avatars stored locally on your device will remain on your device until you manually delete the app. Account deletion does not automatically delete local files.

4. Credit System and Subscriptions

4.1 Credit System

The App uses an in-app credit system for video generation:

• Basic Video (60s): Costs 200 credits
• Premium Video (60s): Costs 800 credits
• New User Bonus: 200 free credits are awarded upon account creation (expires 30 days after signup)
• Monthly Reward: 200 free credits automatically added on the 1st of each month to all users (expires at end of month)
• Sharing Reward: 100 credits earned when you share premium videos to the marketplace (expires 30 days after earning)

4.2 Subscription Plans

Subscriptions are managed through our website (kidsadventure.app), not within the iOS app:

• Weekly Plan: $7.99/week for 800 credits (credits expire after 1 week)
• Monthly Plan: $19.99/month for 3,200 credits
• Yearly Plan: $219.99/year for 41,600 credits
• All subscription management, cancellation, and billing occur on our website
• Subscriptions are subject to the terms and conditions provided at the time of purchase

4.3 Credit Expiration

Credits may expire based on your subscription plan. Unused credits from weekly subscriptions expire after 1 week. We are not responsible for expired credits.

4.4 Credit Purchases

In addition to subscription plans, you may purchase additional credits directly:

• Credit Package: $9.99 for 1,000 Adventure Credits
• Expiration: Purchased credits expire 30 days after the purchase date
• Usage: Purchased credits can be used for any video type (Basic or Premium Video)
• Purchase Location: Credits can be purchased through your account page on kidsadventure.app

4.5 No Refunds

All credit purchases and subscriptions are final. We do not offer refunds for unused credits or subscription fees, except as required by applicable law.

5. Marketplace and Content Sharing

5.1 Marketplace Access

• Anyone can view and share marketplace videos without creating an account
• Account creation is required to like, comment, or purchase story templates from the marketplace
• Content shared to the marketplace is publicly visible to all users

5.2 Content Sharing Rules

When you share content to the marketplace, you agree to:

• Share only content that features your own child or children you have legal permission to feature
• Ensure all shared content is appropriate for a children's app
• Grant other users the right to purchase and use your story templates
• Videos remain in the marketplace until you remove them

5.3 Credit Rewards for Sharing

When you share a video to the marketplace, you will receive 100 Adventure Credits. You also earn 100 credits each time another user purchases your story template. These credits are non-transferable and subject to our credit expiration policies.

5.4 Content Removal

You may remove your shared content from the marketplace at any time. We reserve the right to remove any content that violates these Terms or is otherwise inappropriate.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of all photos, videos, and other content you create or upload using the App ("User Content"). However, by using the App, you grant us a limited, non-exclusive license to:

• Store and process your content as necessary to provide the App's services
• Display your shared content in the marketplace (if you choose to share it)
• Use your content in accordance with our Privacy Policy

6.2 App Content and Technology

All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, software, and trademarks, are owned by Kids Adventure or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6.3 Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Share content that infringes on the rights of others
• Use automated systems to access or use the App

7. Prohibited Conduct

You agree not to use the App to:

• Create, upload, or share content that is illegal, harmful, or offensive
• Impersonate any person or entity
• Harass, threaten, or harm other users
• Interfere with or disrupt the App or its servers
• Attempt to gain unauthorized access to the App or other users' accounts
• Use the App in any manner that could damage, disable, or impair the App
• Share content featuring children without proper authorization

8. Third-Party Services

The App uses third-party services, including:

• AI Services: For video generation and story creation
• Firebase: For authentication, storage, and data management
• Payment Processors: For subscription and credit purchases (on our website)

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

We strive to provide continuous access to the App, but we do not guarantee that the App will be available at all times or free from errors, interruptions, or technical issues.

9.2 Content Accuracy

While we make every effort to ensure the quality of generated videos and stories, we do not guarantee the accuracy, completeness, or suitability of any content generated by the App.

9.2.1 Video Generation Quality

Our video generation technology uses advanced AI to create animated videos from photos and stories. However, due to the nature of AI-generated content, videos may occasionally contain:

• Unnatural movements or transitions between scenes
• Unexpected character positioning or orientation changes
• Minor visual artifacts or inconsistencies
• Variations in animation quality between scenes

These limitations are inherent to current AI video generation technology and are beyond our control. We are not responsible for any such imperfections in generated videos. By using the App, you acknowledge and accept that generated videos may contain these types of visual artifacts.

9.3 Limitation of Liability

To the maximum extent permitted by law, Kids Adventure and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or your account
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content or loss of data

10. Indemnification

You agree to indemnify, defend, and hold harmless Kids Adventure and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Any content you create, upload, or share through the App

11. Termination

11.1 Termination by You

You may stop using the App and delete your account at any time. Account deletion is permanent and will result in the loss of all your data and content.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you violate these Terms.

11.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. We may delete your account and all associated data. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Providing notice through the App or by email (where applicable)

Your continued use of the App after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kids Adventure regarding your use of the App and supersede all prior agreements and understandings.
